Though based on the historic interaction between Atlantic peoples, the Atlantic Civilization only became a reality after World War II with the East West conflict. It comprised a liberal economic order and democratic states, most of which were linked together in a military alliance and led by the United States. The system is now severely challenged by consequences of globalization and a revival of geopolitics, in particular Russia’s intervention in the Ukraine as well as terrorism (...) and the rise of populism. Context: Although ethics consultation is commonplace in United States (U.S.) hospitals, descriptive data about this health service are lacking. Objective: To describe the prevalence, practitioners, and processes of ethics consultation in U.S. hospitals. Design: A 56-item phone or questionnaire survey of the "best informant" within each hospital. Participants: Random sample of 600 U.S. general hospitals, stratified by bed size. Results: The response rate was 87.4%. Ethics consultation services (ECSs) were found in 81% of all general hospitals in the (...) U.S., and in 100% of hospitals with more than 400 beds. The median number of consults performed by ECSs in the year prior to survey was 3. Most individuals performing ethics consultation were physicians (34%), nurses (31%), social workers (11%), or chaplains (10%). Only 41% had formal supervised training in ethics consultation. Consultation practices varied widely both within and between ECSs. For example, 65% of ECSs always made recommendations, whereas 6% never did. These findings highlight a need to clarify standards for ethics consultation practices. (shrink)

In 2014, the United States health care industry produced an estimated 480 million metric tons of carbon dioxide ; nearly 8% of the country's total emissions. The importance of sustainability in health care — as a business reliant on fossil fuels for transportation, energy, and operational functioning — is slowly being recognized. These efforts to green health care are incomplete, since they only focus on health care structures. The therapeutic relationship is the essence of health care — not (...) the buildings that contain the practice. As such, this article will first postulate reasons for a lack of environmental sustainability in US health care. Second, the article will focus on current green health care initiatives in the United States in which patients and physicians participate. Third, the rationale for participation in green initiatives will be explained. Fourth, the article will propose that, based on the environmental values of patients and physicians, health care insurance plans and health care insurance companies can be targeted for green health care reform, thereby closing the loop of sustainable health care delivery. United States Taxes and Tax Policy supplements and complements the theoretical material on taxes found in public finance texts using a combination of institutional, theoretical and empirical information. By adding flesh to theoretical bones, this textbook provides insight into the behaviour of individuals in both the private and public sectors. Specifically, the economic effects of taxes and tax policy are stressed and, as a result, students will gain an appreciation and understanding of how tax policy actually affects the (...) economy. For example, where many texts typically stop with a rather pristine treatment of the income and substitution effects of a tax, this book goes further by examining econometric studies of the supply of labour, and the relationship of this work to taxes, the Laffer curve, and the role and magnitude of the underground economy. Robert Stevens was indicted for marketing dog-fighting videos in violation of 18 U.S.C. § 48, a law criminalizing depictions of animals being "intentionally mutilated, tortured, wounded, or killed..." The law aimed principally at "crush videos," but extended to dog-fighting as well. Stevens challenged the law’s constitutionality and the Supreme Court eventually struck it down. This article explores whether the Stevens decision will have lasting implications for animal cruelty jurisprudence. It argues that the answer is “maybe, but probably not.” In Stevens, (...) the Court skirted the question of whether preventing animal cruelty can rise to the level of compelling state interest. ABSTRACTSome people might argue that there are already too many different documents, guidelines, and regulations in bioethics. Some overlap with one another, some are advisory and lack legal force, others are legally binding in countries, and still others are directed at narrow topics within bioethics, such as HIV/AIDS and human genetics. As the latest document to enter the fray, the UNESCO Declaration has the widest scope of any previous document. It embraces not only research involving human beings, but addresses broader (...) concerns in medicine and healthcare. The UNESCO draft declaration has some minor weaknesses, but on the whole, the strengths outweigh the weaknesses. One weakness is that some items in the draft are stated in a way that is too restrictive, thereby appearing to rule out legitimate activities. A strength of the Declaration is that it is relatively brief, yet at the same time contains sufficient detail to make it something more than a rehearsal of mere pieties. As the most recent of the numerous bioethics and human rights documents, the UNESCO draft draws on many of the earlier documents and also includes some of the most recent thinking about ethical norms and obligations. Perhaps its greatest strength lies not in details of the principles or their implementation, but rather in its stature as an international declaration issued by a United Nations organization. Like Chris Marker's La Jeteé , the accompanying static images distort the viewer's temporality: are these archaeological items, images from a past, or a future? Why isn't this our future? In Between (...) States can also be seen as complementing Larissa Sansour's provocative science fiction works, Space Exodus (2009) which "documents" the Palestinian space program, and her Nation Estate (2012), in which Palestine is relocated into a skyscraper. In 1941 an investigation by the US Justice Department exposed a marriage cartel between John D. Rockefeller’s Standard Oil (now ExxonMobil) and I.G. Farben. The two corporations had formed a joint operation in 1927 called Standard IG Farben. It was revealed that the two had shared patents in order to control prices and markets in their respective regions. Standard was accused of hiding patents from the US Navy and supplying fuel to German submarines, which lead to charges of criminal conspiracy. The Pentagon intervened, requesting that President Roosevelt stop the investigation in order to protect war production and oil supply. Roosevelt agreed, and the Senate committee investigating the matter, headed by Senator Harry Truman, was halted. Standard Oil paid a fine of $5000 and promised to stop supplying fuel to the enemies. Furious at the decision to terminate the investigation of acts he considered treason, Truman initiated a new inquiry into Standard Oil’s war-time practices after succeeding Roosevelt as president in 1945. With the chief executives of I.G Farben simultaneously on trial at Nuremburg, Truman brokered a deal with the Allies that reduced or withdrew criminal charges leveled against both corporations in exchange for Standard Oil and I.G. The third critical player in this bold experiment was the nascent North Atlantic Space Agency. Formed by Allied forces using the seized assets and engineering expertise of Hitler’s hitherto classified space program (conquer Earth, then the stars), the North Atlantic Space Agency was a pre-NATO foray into interstellar nation building, with orbital occupation as the first point of order. By 1947, NASA was nearly ready to deploy the first manned space station. Standard Oil and I.G. Leaders of the continental nations demonstrated, at best, reluctance to accommodate the Jews, who in turn were, at the least, resistant to returning to the same bloody cocktail from which they had fled. On December 30, 1947, one month after the UN General Assembly voted down the separation plan for Palestine, Exodus rocketed into the atmosphere hauling the first module of barracks designed to house 1,500 refugees. Additional installations were positioned to form swollen clusters of interlocking units – sleeping quarters, schools, clinics, canteens. The UN was brought in to monitor the camp following two chaotic years of US Army control in which food shortages, pandemic diseases, and rampant black market trade had brought the camp to near total collapse. No less bureaucratic or ineffectual, the UN relief agency at least had prior experience facilitating contexts of a similar magnitude and could potentially predict outcomes. What had been unexpected was the degree to which the camp would evolve into its own self-regulated, hive-like ecosystem where previously accepted rules of conduct were not applicable. The ODP camp was an exceptional space, a riverboat casino, an offshore research lab of social experimentation and entrepreneurial innovation. No longer Earth-bound, touching soil knotted by prescripts of Talmudic law, the camp residents were able to rationalize loopholes and detonate barriers standing in the way of absolute production. The Jewish archipelago was renamed Israel after the ancient homeland. If the temple couldn’t be rebuilt in the motherland, a post-national rhizome would sprout up in its stead. Science motivational beliefs are crucial for STEM (science, technology, engineering, and math) performance and persistence, but these beliefs typically decline during high school. We expanded the literature on adolescents’ science motivational beliefs by examining: 1) changes in motivational beliefs in three specific science subjects, 2) how gender, immigrant generation status, and perceived support from key social agents predicted differences in adolescents’ science motivational beliefs, and 3) these processes among Latino/as in the United States, whose underrepresentation in STEM is (...) understudied. We used hierarchical linear modeling to estimate the changes in 104 (40% female) Latino/a high school students’ physics, chemistry, and biology motivational beliefs from 9th to 11th grade. Subject-specific ability self-concept, interest, and utility were regressed on gender, immigrant generation status, and perceived science support while controlling for family income, parent education, and adolescents’ school. Adolescents’ utility declined from 9th to 11th grade whereas their interest remained stable for all three science subjects. Adolescents’ ability self-concept increased for biology, decreased for physics, but remained stable for chemistry. Gender differences in adolescents’ motivational beliefs at 9th grade only emerged for physics utility as well as physics and chemistry interest; yet, there were no gender differences in how adolescents’ science motivational beliefs changed over time. Contrary to expectations, immigrant generation status was not significantly associated with adolescents’ science motivational beliefs at 9th grade or in terms of how they changed over time. Adolescents who perceived higher science support generally had higher motivational beliefs in 9th grade, but did not differ on their rate of change. Our findings highlight the need to examine specific science subjects, and that typical gender differences in adolescents’ motivational beliefs discussed in the literature may not generalize to all racial and ethnic groups. Ageism is a pan-cultural problem, and correspondingly, increased research attention worldwide has focused on how a person’s age drives prejudice against them. Nevertheless, recent work argues that chronological age alone is a limited predictor of prejudice—particularly in the workplace, where age conflates intertwined elements, and across cultures, in which the nature of ageism can substantially differ. A recent organizational behavior framework advocates for extending beyond numerical age alone, focusing instead on prejudice arising from workers’ perceived Generation, Age, Tenure, and Experience. (...) In addition to clarifying the multifaceted nature of workplace ageism, GATE helps uncover potential cultural ageism differences. Using the United States and China as focal Western and Eastern prototypes, the current paper compares Eastern and Western cultures through a GATE Lens. Eastern and Western cultures adopt different perceptions of generations, elder life stages, organizational tenure expectations, and desired experience levels. Moreover, existing research offers clues for how workplace GATE-ism likely differs between cultures, but more research is needed. Future research should adopt a nuanced GATE conception of “age”-ism, toward enhanced ageism understanding and the ability to utilize a globally aging workforce. (shrink)

In today's global marketplace, the Philippines provide a unique example of an Asian culture with established economic ties to the West. In this study, Philippine and United States undergraduate business students responded to 13 vignettes describing questionable ethical actions in business situations. Results reveal significant differences between groups for 9 of the 13 vignettes. For 4 vignettes, Philippine participants were more disapproving of the actions, and for another 5, United States participants were more disapproving. There are several different types of capitalist political-economies and business organizations. Consequently, the implications for business citizenship behaviors are also quite different. In the older “large family owned business” and “managerial capitalism” forms there are important structural opportunities for a social contract and balancing of the needs of various stakeholder groups. In the “investor capitalist” form which emerged in the 1980s and has come to dominate the U.S. political-economic system, there is a dominant priority toward optimization of the shareholder wealth (...) criterion which makes it very difficult for such business organizations to engage in authentic citizenship behaviors. The United States Supreme Court's decision in Bell Atlantic Corp. v. Twombly is creating quite a stir. Suddenly gone is the famous loosey-goosey rule of Conley v. Gibson that a complaint should not be dismissed for failure to state a claim unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.Now a complaint must provide enough facts to state a claim to relief (...) that is plausible on its face. Only decided last May, Bell Atlantic has been cited in over 3,700 cases. Already being described as a landmark decision, Bell Atlantic nonetheless has lawyers and judges scratching their heads over the precise pleading standard to apply in its wake. As the Second Circuit (mildly) put it, Considerable uncertainty concerning the standard for assessing the adequacy of pleadings has recently been created by the Supreme Court's decision in Bell Atlantic Corp. v. Twombly. Just what is a plausible showing that the pleader is entitled to relief under Rule 8(a)(2)?I believe an answer lies in the 26-year-old decision of the Former Fifth Circuit in In re Plywood Antitrust Litigation. Plywood Antitrust requires, at a minimum, that a complaint . . . contain either direct or inferential allegations respecting all the material elements necessary to sustain a recovery under some viable legal theory. Already used in more than half the circuits, this standard paraphrases advice found in the venerable WRIGHT & MILLER for nearly 40 years.Properly applied, this all . . . material elements standard satisfies Bell Atlantic's plausibility requirement in all respects. The Plywood Antitrust pleading standard works well after Bell Atlantic, first, because the Supreme Court referred to the standard, albeit parenthetically, with approval in Bell Atlantic. Second, it does much to harmonize the Federal Rules' goal of dispensing with pleading technicalities while still requiring enough general factual information about a pleader's claim to make the notice in notice pleading meaningful. Finally, and perhaps most importantly, it gives lawyers, litigants, and courts a standard they can actually use when drafting, or assessing the sufficiency of, pleadings. (shrink)

Recently, John Doe, an undocumented immigrant who was detained by United States Immigration and Customs Enforcement, was admitted to a hospital off-site from a detention facility. Custodial officers accompanied Mr. Doe into the exam room and refused to leave as physicians examined him. In this analysis, we examine the ethical dilemmas this case brings to light concerning the treatment of patients in immigration detention and their rights to privacy. We analyze what US law and immigration detention standards allow (...) regarding immigration enforcement or custodial officers’ presence in medical exams and documentation of detainee health information. We describe the ethical implications of the presence of officers in medical exam rooms, including its effects on the quality of the patient-provider relationship, patient privacy and confidentiality, and provider's ability to provide ethical care. We conclude that the presence of immigration enforcement or custodial officers during medical examination of detainees is a breach of the right to privacy of detainees who are not an obvious threat to the public. We urge ICE and the US Department of Homeland Security to clarify standards for and tighten enforcement around when officers are legally allowed to be stationed in medical exam rooms and document detainees’ information. Networks for the exchange and/or sharing of genetic data are developing in many countries. We focus here on the situations in the US and France. We highlight some recent and remarkable differences between these two countries concerning the mode of access to, and the storage and use of genetic data, particularly as concerns two-sided markets and dynamic consent or dynamic electronic informed consent. This brief overview suggests that, even though the organization and function of these two-sided markets remain open to (...) criticism, dynamic e-IC should be more widely used, especially in France, if only to determine its real effectiveness. Based on a multivariate analysis of the involvement of post-Soviet republics in UN and NATO peacekeeping operations, the author explores the integration of New Independent States into UN and NATO international organizations. Chronology of some peace-support and peace-enforcement operations is given. Of special focus is participation of special units of armed forces in such operations. Logical sequence of intrastate agreement on engagement of the military of independent Ukraine in international operations under the mandate of the United Nations Security (...) Council is traced. A respective decision-making process of the Lithuanian Parliament is examined for comparison purposes. Specific laws of Ukraine, which regulate such decisions, are indicated. The author offers concrete examples and describes the role of the North Atlantic Treaty Organization in implementation of the UN peace-support mission. The paper cites Russian legislation governing cooperation with the UN and NATO in peacekeeping operations. By the example of formation of interstate military units between Ukraine, Poland and Lithuania ('Ukrpolitbat'), the Baltic Republics (the 'Baltic Battalion') and Central Asian Republics ('Kazbat'), the author shows the initiative of post-Communism republics in preservation of peace and stability in the world. Specific examples of involvement of the armed units of such post-Soviet republics as Ukraine, Lithuania, Latvia, Estonia, Georgia, Kazakhstan, Uzbekistan and Kirgizia in UN international operations are given. The paper describes the operations in Kosovo (1999), the Mediterranean Sea (2001), Turkey (2003), Iraq (2004), Bosnia and Herzegovina (1996-2004) as well as Sudan (2005). Attention is drawn to reorientation of the NATO from the collective defence strategy to that of common security and execution of mostly international operations with domination of police functions, technical assistance in the postwar period and coping with technogenic catastrophes. This study investigates: the changes in three major health-related factors—physical activity, non-physical-activity health behavior, and depressive symptoms, and how changes in physical activity were associated with changes in one’s depressive symptoms among young adults, middle-aged adults, and older adults while controlling non-physical-activity health behavior and sociodemographic characteristics among young, middle-aged, and older adults before and after the COVID-19 outbreak lockdown in the United States. A total of 695 participants completed an online questionnaire via MTurk, and participants were asked (...) to recall their physical activity, depressive symptoms, and non-physical-activity health behavior status in January and May of 2020. The IPAQ-SF was used to evaluate individuals’ physical activity, while the CES-D-10 was used to assess depressive symptoms. Covariates included non-physical-activity health behavior and sociodemographic factors. A Bayesian significance testing of changes was used to examine significant changes in physical activity, non-physical-activity behavior, and depressive symptoms in each age group while Bayesian regression analysis was employed to examine how the changes in physical activity were associated with respondents’ depressive symptoms while controlling for individual NHB and sociodemographic characteristics. The results showed that the participants tended to maintain their physical activity levels after the lockdown despite significant increases in sitting time among young and older adults. Decreases in moderate physical activity frequency were associated with a higher level of depressive symptoms. Although young and middle-aged cohorts experienced fewer differences in depressive symptoms compared to their counterparts in the older group, we found no significant heterogeneity effects in the relationships of interest across all age groups. Considering different influences of physical activity on depressive symptoms depending on different levels of activity and ages, more randomized clinical trials with program-based intervention studies should be conducted with different physical activity programs for different age populations. Thomas Jefferson praised Tom Paine as the greatest political writer of the age. The author of 'Common Sense' and Rights of Man, Paine helped make revolutions in America and France. But beyond his inspiring calls to action, Paine harbored a deeper political vision for his adopted country. It was embodied in an architectural project that he spent decades (...) planning: an iron bridge to span the Schuylkill River at Philadelphia. The United States Court of Appeals for the Third Circuit held that when quitam relators file a multi-claim complaint under the Fraudulent Claims Act, their share of the proceeds must be based on an individual analysis of each claim. More importantly, the court held that relators are not entitled to any portion of the settlement of a specific claim if that claim was subject to dismissal under section 3730 Relator Merena filed a quitam suit against his employer, SmithKline (...) Beecham, claiming, among other things, that SKB defrauded the government by billing for laboratory tests that were not performed, paying illegal kickbacks to health care providers, and participating in an “automated chemistry” scheme. In response to the need for Holocaust curricula in Latvia, Latvians and Americans worked collaboratively to overcome the historical silence surrounding this event. During their project, Latvian curriculum writers worked with teachers and scholars at the United States Holocaust Memorial Museum. This descriptive analysis of the Latvians' experience with Museum Fellows revealed opportunities to learn from each other the complexities of teaching the Holocaust in a country viewed by some as collaborators and still somewhat anti-Semitic. Findings included depth (...) of guidance, values, and limits of innovative teaching methods, cross-cultural benefits, and continued collaboration. Recommendations for future efforts by post-Communist countries and American partners to develop curriculum on teaching a most complex and contentious aspect of history such as the Holocaust conclude the study. Previous studies have addressed many different kinds of confessions in police investigations – real, false, coerced, fabricated – and highlighted both psychological and social mechanisms that underlie them. Here, we focus on inadvertent confessions and admissions, which occur when a suspect appears to be confessing without being fully aware of doing so, or when police officers believe they have a confession or admission of guilt when in fact this is not the case. The goal of the study is to explain (...) when, how and why these confessions and admissions occur as well as how they are dealt with in two different jurisdictions, the United States and the United Kingdom. We use a discourse analysis approach because inadvertent confessions and admissions of guilt are the product of miscommunication – they happen because the speaker’s meaning and the hearer’s meaning are misaligned. The data consist of 50 interviews from the United Kingdom and 50 interrogations from the United States with both English-speaking and non-English speaking suspects. Our results demonstrate that inadvertent confessions can occur in both locales due to reliance on inference, which is inevitable since inference is the backbone of any human communication, as well as due to additional factors such as linguistic, cultural and procedural issues. We found that these phenomena are more frequent and less well controlled for in the United States context due to no systematic checking of understanding, adversarial questioning techniques and an absence of legal representation, and lack of professional, high-quality interpreting. We discuss the implications of our findings for current efforts to improve access to justice, custodial procedures and language services, and we make recommendations for the implementation of our research in professional practice. There is widespread and growing concern among U.S. consumers about the treatment of farmed animals, and consumers are consequently paying attention to food product labels that indicate humane production practices. However, labels vary in their standards for animal welfare, and prior research suggests that consumers are confused by welfare-related labels: many shoppers cannot differentiate between labels that indicate changes in the way animals are raised and those that do not. We administered a survey to 1,000 American grocery shoppers to better (...) understand the extent to which consumers purchase and pay more for food with certain labels based on an assumption of welfare improvement. Results showed that 86% of shoppers reported purchasing at least one product with the following labels in the last year: “cage or crate-free”, “free-range”, “pasture-raised”, “natural”, “organic”, “no hormone”, “no antibiotic”, “no rBST”, “humane”, “vegetarian-fed”, “grass-fed”, “farm-raised”. Of those who purchased one of the aforementioned labels, 89% did so because they thought the label indicated higher-welfare production practices, and 79% consciously paid more for the product with the label because they thought that the label indicated better-than-standard animal welfare. However, many of these labels lack uniform standards for the production practices they represent, and some labels represent production practices that do not influence animal welfare, thus the degree of the animal welfare impact of a given label is highly variable. These results indicate that labels need to clearly and accurately specify their animal welfare benefits to improve the consumers’ ability to purchase products that align with their expectations. During the first years of organized agricultural research in Mexico in the 1940s, two agencies ran separate programs for corn improvement. The Rockefeller Foundation's Office of Special Studies and the Mexican government's Office of Experiment Stations carried out research on corn with distinct aims and methods. That they differed strongly is well established in the literature. Many authors have discussed a Rockefeller Foundation program that reportedly emphasized hybrid corn, a technical choice that embodied a preference for assisting wealthy farmers who (...) could afford hybrid corn and the necessary agricultural inputs. Conversely, these authors attribute to the Mexican program a focus on open-pollinated corn, which presumably manifested its concern for Mexico's small farmers who saved seed. This article argues that the reverse was true. The Rockefeller Foundation program initially was committed to a type of improved open-pollinated corn while the Mexican program proceeded with a strict, U.S.-style hybrid program. I try to illuminate each group's priority on yield, as well as additional significant, and complicating, breeding priorities that precluded any collaboration between the two. (shrink)

Between 1820 and 1870, middle-class Americans became convinced of the role nonhuman animals could play in socializing children. Companion animals in and around the household were the medium for training children into self-consciousness about, and abhorrence of, causing pain to other creatures including, ultimately, other people. In an age where the formation of character was perceived as an act of conscious choice and self-control, middle-class Americans understood cruelty to animals as a problem both of individual or familial deficiency and of (...) good and evil. Training children to be self-conscious about kindness became an important task of parenting. Domestic advisors also argued that learning kindness was critical for boys who were developmentally prone to cruelty and whose youthful cruelty had implications both for the future of family life and for the body politic. The practice of pet keeping, where children became stewards of companion animals who were then able to teach young humans such virtues as gratitude and fidelity, became a socially meaningful act. This article presents a unified, multidimensional, and relational approach to Atlantic history by treating the Atlantic as a historical region of the capitalist world economy. In contrast to more conventional comparative approaches, the approach presented here grounds Atlantic history in the longue durée geographical historical structure of the maritime Atlantic and construes particular political, economic, social, or cultural units as parts of the more encompassing Atlantic and world economies. Within this framework, particular units or relations (...) are viewed as complex historical outcomes of relations and processes operating across diverse spatial and temporal scales. Thus each unit is related to the others, and each occupies a distinctive location in the maritime Atlantic division of labor. Through an example of plantation slavery, the article examines the ways in which specific units are formed within the larger historical field and examines the variation among them. By calling attention to the relations among units over time and in space within a unified historical field, it identifies specific conjunctures and contingencies shaping Atlantic history. (shrink)
